These Terms of Service ("Terms") govern your use of our website, services, and sales pages (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.1. Eligibility and Account Registration
- Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement to use our Services. By enrolling in our programs, you confirm that you meet these requirements.
- Account Registration: To access our Services, you may be required to register an account via Trainerize or other platforms we use. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- Health Clearance: You confirm that you have consulted with a healthcare provider before starting our programs and that you have no medical conditions that would prevent participation. We may require a medical clearance form for certain clients, particularly for the Elite Program involving blood work analysis.2. Program Participation
- Core Program: Includes comprehensive onboarding (diet, movement, health assessments), personalized nutrition and workout plans via the Trainerize app, weekly check-ins, 24/7 text support (responses within 24 hours), 1:1 coaching calls (1/month), and access to our client community and group coaching calls/webinars.
- Elite Program: Includes all Core features, plus advanced onboarding (blood work analysis, tailored supplementation), unlimited 1:1 coaching calls, 24/7 proactive text support, Monthly Progress Reports, Metabolic Mastery Toolkit, monthly Success Summits, and gamification in Trainerize.
- Client Responsibilities: To achieve desired outcomes, you agree to maintain 80% compliance with program requirements (e.g., tracking meals, workouts, attending check-ins). You must complete onboarding tasks (e.g., assessments, app setup) within 2–4 weeks of enrollment to start your program.
- Blood Work (Elite Program): Elite clients must submit blood work via a secure DocuSign link, as outlined in our onboarding process. You authorize us to review your blood work for coaching purposes, and you confirm that you have the legal right to share this data. We handle blood work in compliance with HIPAA regulations.3. Payment Terms
- Payment: You agree to pay the fees for your selected program as outlined during enrollment. Payments are processed securely through third-party payment processors (e.g., Stripe). You authorize us to charge your payment method for all fees, including any applicable taxes or transaction fees (e.g., Stripe fees of 2.9% + $0.30 per transaction, which are non-refundable).
- Re-Sign Subscriptions: After completing your initial program term, you may opt into a month-to-month re-sign subscription. Fees for re-sign subscriptions are charged monthly until canceled, as outlined in our Fulfillment Policy.
- Late Payments: If payment fails, we may suspend your access to the Services until payment is received. You are responsible for any fees incurred due to failed payment attempts (e.g., overdraft fees).4. Refunds and Cancellations
- Refund Policy: Refunds are available as outlined in our Fulfillment Policy:
- Core Program: Within 14 days of payment if services are not delivered as promised.
- Elite Program: Within 30 days of payment if services are not delivered as promised.
- Performance-Based Guarantee: If you maintain 80% compliance for the first 30 days and do not see measurable progress (e.g., weight loss, improved energy levels, or other agreed-upon metrics), you may request a refund within 5 business days following the 30-day period, with evidence of compliance (e.g., Trainerize logs).
- Cancellation Policy: You may cancel your program or re-sign subscription with 30 days’ written notice via email to [email protected]. No refunds are provided for the current billing cycle, and services continue until the end of the notice period. You may also pause your program for up to 8 weeks in cases of financial hardship or medical issues, as outlined in our Fulfillment Policy.
- No Guarantee of Results: While we offer a performance-based guarantee, results are not guaranteed beyond this provision. Outcomes depend on your compliance, individual health factors, and adherence to the program. We are not responsible for failure to achieve specific goals (e.g., weight loss, muscle gain).5. Intellectual Property
- Ownership: All content provided through our Services, including workout plans, nutrition guides, Metabolic Mastery Toolkit, and Success Summit materials, is the intellectual property of Fit 4 Life Systems LLC or our licensors. You are granted a limited, non-exclusive, non-transferable license to use this content for personal, non-commercial use during your program.
- Restrictions: You may not reproduce, distribute, modify, or create derivative works of our content without prior written consent. Unauthorized use may result in termination of your access to the Services and legal action.6. Third-Party Services
We use third-party services to facilitate our programs, including:
- Trainerize: For delivering workout and nutrition plans, tracking progress, and client communication.
- Stripe: For securely processing payments.
- DocuSign: For securely receiving blood work (Elite Program), in compliance with HIPAA.
These third parties are contractually required to maintain the security of your information and use it only for the intended purposes. We are not responsible for the performance or policies of third-party services.7. Health and Safety Disclaimer
- Not Medical Advice: Our Services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a healthcare provider before starting any fitness or nutrition program, especially if you have pre-existing conditions or are taking medications.
- Assumption of Risk: You participate in our programs at your own risk. We are not liable for any injuries, health issues, or adverse effects resulting from your participation, including but not limited to exercise, dietary changes, or supplementation recommendations.
- Blood Work Analysis: For Elite clients, blood work analysis is provided for coaching purposes only and does not constitute medical diagnosis or treatment. You are responsible for consulting a healthcare provider to interpret your blood work results.8. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to loss of data, profits, or health outcomes.
- Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid for the program in the preceding 12 months.
- We are not responsible for delays, interruptions, or failures in service delivery due to factors beyond our control (e.g., internet outages, third-party service failures).9. Indemnification
You agree to indemnify, defend, and hold harmless Fit 4 Life Systems LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.10. Termination
- By You: You may terminate your participation by canceling your program or subscription as outlined in our Fulfillment Policy.
- By Us: We may terminate or suspend your access to the Services at our discretion, with or without notice, for reasons including but not limited to non-payment, violation of these Terms, or behavior that disrupts our operations or other clients (e.g., harassment, misuse of community features).
- Effect of Termination: Upon termination, your access to the Services will cease, and no refunds will be provided for the current billing cycle, except as outlined in our Fulfillment Policy.11. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of [Your State, e.g., New York], without regard to its conflict of law principles.
